Which of the following most accurately describes the problem?

I know that! have to

keep tachograph records for 12 months and have to produce them to police and ministry examiners. Sometimes the records in my files go back more than 12 months. Can they insist on seeing the ones which are over 12 months old ?

A No. The power of police

and examiners to require production of tachograph records is contained in Section 99 (1) (bb) of the Transport Act 1968.

It states that an officer may require any person to produce and permit him to inspect and copy "any record sheet which that person is required by Article 14 (2) of the Community Recording Equipment Regulation to retain or by Article 15 (7) of that Regulation to be able to produce".

Because Article 14 (2) requires record sheets to be kept for one year only the power in Section 99 (1) (bb) is restricted to that period.
