Evidence was heard that 27 the fleet were tippers and that the work was critical and the cause of many breakages. The company employed eight mechanics and two apprentices, a tyre fitter and a general labourer on maintenance; they had also arranged 1,vith FTA to do spot checks monthly and had a contract with a tyre Company doing similar checks. They had adopted every possible means of checking their vehicles.
On May 15 there were checked 8 vehicles, on which 3 GV9s were issued, at a quarry. Not one of the items indicated neglect; all were consistent with damage resulting from heavy work. The company maintained their vehicles seven days each week and two nights each week; all the defects were such as could occur at any time on tipper work.
Maximum care was taken and the company did not believe it was possible to do more. In granting the ten trailers and absolving the firm on the show cause appearance, the Deputy Mr A. Moodies said that he was satisfied they were responsible operators, and that their maintenance arrangements were sound. The defects were not due to neglect but was the result of rough work: He varied the license to add ten trailers.
