• A lorry driver who crashed into a motorway central reservation is facing a High Court action to make him pay for repairs to the crash barrier.

The Department of Transport is claiming damages from Norman Birkett of Gainsborough Road, Scotter, Lincs, and from his employer, Tarmac Roadstone and Eastern of Ettings Hall, Wolverhampton.

The accident happened on the M180 on 9 October 1987. when Birkett lost control of the Seddon Atkinson lorry he was driving, according to a High Court writ. The lorry collided with the central reservation near Castlethorpe Road Over Bridge, causing damage which cost £5,093 to repair, the writ claims.

Birkett was allegedly negligent because he drove too fast, failed to keep a proper look out, lost control of the lorry and collided with the reservation, the writ says.

The lawsuit was filed by the Treasury Solicitor.
