A WARDING Mrs. H. Hilton, of ri Ch a cider ton, £325 damages,, with £59 for loss of earnings, on a claim arising out of an injury to her right hand sustained in a bus accident, Judge F. Raleigh Batt, at Oldham County Court last week, said that it was monstrous that an Oldham Corporation bus did not have safety glass in the side windows.

It was submitted for Mrs. Hilton that in September last she was a passenger on the bus, stated to be 16 years old, which jerked when she stood up to leave her seat. She lost her balance and when she put her hand out to steady herself, it went through a window. The . ring finger of her right hand would be permanently deformed.

For the corporation, Mr. J. G. Shorrocks said that safety glass was compulsory for forward windows, and the use of ordinary glass in side windows was common. It could not be said that the corporation had been negligent. All new buses were being fitted with safety glass in every window. The vehicle concerned was given a certificate of fitness in 1954, he stated.

The judge said that it was the duty of the corporation safely to carry the plaintiff as a fare-paying passenger, and they had not done so.
