• North Western LA Martin Albu has adjourned consideration of possible disciplinary action against Derby-based Sanroy Haulage pending the production of accounts.

Albu said that he had granted the company a licence for five vehicles and five trailers in October 1993 but it appeared that he was given incorrect information at that time. When questioned about the unauthorised use of vehicles, director Royce Ulla had told him on several occasions that he had a licence in the name of Ramgrove in the Eastern Traffic Area.

Albu had been told that a licence was granted in the Eastern Area until August 1992, but the renewal was not taken up. Ulla then operated under a licence in the North West. In October 1992 he was made bankrupt and the licence was revoked in July 1993. Between July and October 1993 Ulla had no licence.

The second issue, said Albu, was that no financial information had been received. Ulla had said that in October 1993 there was none as the company had only just started trading. The company had in fact been in existence for three years, but no accounts had been filed at Companies House.

Asked to explain this, Ulla said the accountant had been given the figures. Draft accounts were produced but the accountant never went any further. He had changed accountants and the new accountant would be filing the accounts. Ulla said there was sufficient finance to run the company's vehicles and financial evidence was heard in private at his request.

For Sanroy, Anton Balkitis said that Ulla had tried to do everything by the book. Though he might well have operated illegally for a time, Ulla had acted in ignorance. It had not been his intention to deceive the Traffic Area. He thought he had a licence and was entitled to trade. "He is the sort of man to say why should I have to provide my accounts? He has never liked bureaucracy" said Balkitis.

Ulla said that in the 1980s he was fined £8,000 for having no 0licence. The company had done everything not to be "cowboys" and tried to operate legally. Every time the vehicles had been inspected by the DOT they had been in Al condition. He felt he was one of the better hauliers.

Adjourning the hearing, Albu said that a number of false statements had been made. He did not know whether that was deliberate or not. He wanted accounts by 25 March for the trading period ending March 1993 and the March 1994 accounts were required by the end of October.
