Thomas Studders, of Burton Manor, Stafford, had admitted the offences before Chester Magistrates, who remanded him to the Crown Court in order to be sentenced, because they believed their powers of punishment were insufficient.

Prosecuting for Vosa, Rachel Vaux said that in September, a 44-tonne attic belonging to Professional Handling With Care, and being driven by Studders, was stopped in a cheek at the Dunkirk Weighbridge.

When Studders produced his tacho records, a number of offences were immediately apparent. It was obvious to the traffic examiner there was a misalignment of the distance traces, and there was also a disparity between the handwritten odometer readings and the distance trace.

Studders had said that when stuck in traffic and unable to take his breaks, he would take the chart out until he reached a destination where he could take his break. Subsequent analysis of 83 charts that were produced by the firm showed that the offences detected at the roadside had not been committed in isolation.

The 25 offences Studders had pleaded guilty to had been committed between 21 June and 18 September 2007. There was a total of 1.468km unrecorded, ranging from 12km to 130km per journey. Largely there was one period in each day unrecorded, but on two days in September, there were three and four missing periods respectively.
