• A single prohibition showing a significant maintenance failure led to a St Helens demolition contractor being called to appear at a Leeds disciplinary inquiry

North Western Deputy Traffic Commissioner Pat rick Mulvenna was considering action against the one-vehicle licence held by Michael Connolly, trading as M Connolly Demolition & Plant Hire.

Vehicle examiner Eric Bober told the inquiry that he had issued an immediate prohibition on Connolly's vehicle listing six faults to its brakes, steering, the exhaust system and the offside front wheel rim.

The inspection records that were produced were incomplete, Bober added. He was told that the vehicle was maintained every six weeks by Connolly's father and Connolly was surprised that the vehicle was not in a satisfactory condition. of the records, he told the inquiry.

Asked why the vehicle was found to be in such a condition, Connolly said that it went onto a lot of rough tips. In future it would be looked at every four weeks instead of six.

Issuing a warning, Mulvenna said he took account of the fact that this was a single prohibition, albeit a serious one, in an otherwise clean record.

He called for a further maintenance investigation to be carried out within six months and warned Connolly that if the situation was repeated, action would be taken against his Operator's licence.
