The judicial review, before Lord Justice Watkins and Justice Hutchison, heard Anthony Lester QC argue for the industry that demanding air-brake silencers as a condition of exemption from the London lorry ban went beyond European Community law.

Lester said the ban affects 5,000 lorry operators and 40,000 vehicles. His clients (the FrA, RHA, SMMT and five operators) were not challenging the ban itself, only the air-brake silencer conditions.

The RHA and FrA have advised their members to ask for temporary permits, pending the judicial review finding.
