Driving a vehicle away from a test station after it had been given an immediate prohibition cost a Hertfordshire owner-driver 1900 in fines and costs.

Mark Alsford, of Hocklesidon, denied using the vehicle whilst the subject of a prohibition notice when he appeared before Enfield Magistrates.

Prosecuting for the Vehicle Inspectorate, Anthony Ostrin said that Alsford had presented the vehicle for test at the Edmonton Test Station at the beginning of September last year. A number of faults were found, including a serious brake defect. As a result an immediate prohibition was issued. Alsford was told that the vehicle could not be driven on the public road. But Alsford said that he was not going to leave the vehicle there and he drove off, said Ostrin.

Alsford told the magistrates that it was a Saturday and as the test station was so close he was not prepared to leave his loaded vehicle there unattended. He claimed that he had arranged with a friend to tow the vehicle away and that that was what he did.

The vehicle was subsequently re-presented after having work done to it, said Alsford. it failed the test again but was only given a delayed prohibition which he thought would have been appropriate 'rite first place.

Ostrin pointed out that the offence was committed on the first occasion when Aisford acted totally in contradiction of the notice served upon him.

The magistrates found Alsford guilty, imposing a .R600 fine and 1300 costs.
