• A Cheshire skip hire oper ator has succeeded in having restrictive environmental conditions removed from his licence.

North Western Deputy Traffic Commissioner Patrick Mulvenna was considering taking action against the 12-vehicle licence held by Cyril Henshaw, trading as Henshaws Waste Management Services, of Macclesfield. He was also hearing an application to remove licence conditions governing the times of operation.

When the case first came before the Deputy Traffic Commissioner in January, Henshaw admitted using vehicles on a Sunday in contravention of the conditions (CM30 Jan-5 Feb). For Henshaw, Fred Randall said that various other businesses operated from the site at Moss Lane without restriction.

Henshaw had accepted the conditions when the authorisation on his licence was increased from seven vehicles The restr but he had believed that they applied only to the additional vehicles. The conditions had been strictly adhered to since January, said Randall.

Senior traffic examiner Anthony Smith told the Trafford public inquiry that Bostocks Coaches operated from the site and Effluents Services operated from another site in Moss Lane. He did not consider that the number of vehicle movements in and out of the yard would have a great effect on nearby residents.

Henshaw said that the restriction on movement on Sundays and bank holidays prevented him from fulfilling some contracts. Randall pointed out that there had been only one letter from a neighbouring resident, who had not seen fit to attend the public inquiry. Taking no action, and removing the conditions, Mulvenna said that in view of the other operations in the area, he doubted that Henshaw added significantly to the environmental disturbance.
