FINDINGS of the Appeal Tribunal requiring certain proofs in cases of carriers' businesses changing hands, were stated by •Sir William Hart, North Western Deputy Licensing Authority, on Monday, to have made it difficult for these transactions to be proved.
Mr. Harry Lomax, of Bury, was applying for a B licence to enable a motor vehicle now operated under a C licence to be used for a coal and carrier's business bought in February, 1935, and worked for 12 months with a horse and cart. Sir William Hart required proof of the transaction in
accordance with the Appeal Tribunal's decisions:
Mr. H. Backhouse, for the applicant, pointed out that his evidence was of a bona fide business purchased 17 Months ago and carried on genuinely for 12 months. He had not anticipated that, in a Section 6 application, proofs as in Section 11 (3) (b) cases would be
required. • A day would be occupied in hearing each case if all these details were to be asked for. In this case, it would man bringing a man from Cornwall.
An adjournment was granted to enable further evidence to be submitted.
