Which of the following most accurately describes the problem?

• The Office of Fair Trading is to take proceedings in the Restrictive Practices Court over a fare fixing agreement between two Leicestershire bus operators.

The OFT says an agreement between Midland Fox, which operates 317 vehicles, and G K Kinch, which runs 20, involved fixing fares and rerouting services, including the withdrawal of some buses and a decision not to run a certain bus on a Sunday.

Anyone adversely affected by the operation of the agreement may have grounds for seeking damages in the courts, says the orr.

No comment was available from either company.

CI Since de-regulation the bus industry has been subject to the provisions of the Restrictive Trade Practices Act, and the OFT has declared its intention to "take action in the court against any operators who make a covert, and therefore unlawful, agreement".
