Which of the following most accurately describes the problem?

WHEN a person is prosecuted for any offence listed in Part I or Part II of the First Schedule to the 1962 Road Traffic Act he must deliver his driving licence to the court, or post it by registered post or recorded delivery so that it is delivered not later than the day before the hearing, or have it with him at the hearing.

If he is convicted and the court orders his licence to be endorsed the licence must be produced. If it has not been sent or brought to the court the defendant is liable to a fine not exceeding £50 and the licence is suspended from the time when its production was required until it is produced to the court. This, of course, is a serious matter because if driving was continued during this period a charge of driving while not being the holder of a driving licence is likely to be preferred. If after the expiration of six months he starts driving again and shortly after, say three months later, his is again unfortunate enough to be convicted of an offence which carries endorsement of his licence, he can again be disqualified under the "totting up" procedure for a further .six months.
