Which of the following most accurately describes the problem?

• An Aberdeen scrap metal dealer had his operator's licence suspended for two months by the Scottish LA, Mr A. B. Birnie, following an overloading conviction.

The traffic examiner, Mr J. Bisset, told the court that the vehicle, belonging to Mr D. McAllister of Powis Place, Aberdeen, was plated for operation at 4 tons 4cwt but when examined was found to be 7 tons 3-cwt.

Mr McAllister explained that on the day in question he had not been on the premises when his driver loaded the vehicle with scrap metal and drove it from the yard. He said the driver was dismissed when the matter came to light.

Mr Birnie considered the case to be too bad for the owner to receive a warning only and therefore decided to suspend the licence for August and September and to delay his decision on an application by Mr McAllister to renew his licence until the suspension expires.
