Which of the following most accurately describes the problem?

• TNT Express is appealing against an industrial tribunal decision to award £80,000 compensation to 13 of its former employees who were sacked for going on strike.

The award was made in February to 11 drivers and two warehousemen who were among 120 staff dismissed by TNT Express after a stoppage at its depot at Cannock, Staffs. The strike was in support of shop steward Alf Cooke, sacked after calling a mass meeting without company consent. A tribunal has ruled that Cooke was fairly dismissed. George Lawson, TNT head of group employee relations, says the company's appeal will seek to clarify employment law which prevents employers who have dismissed strikers from selective reemployment. TNT has taken back some of the 120 sacked workers.

Lawson believes the appeal could be heard "anytime in the next 18 months".
