4LTHOUGH there is no specific exemption from the tachograph or Myers' hours regulations for vehicles used for non-commercial mrposes, it is strongly arguable that the regulations do not apply at sll to privately owned and driven vehicles, Junior Transport Minister Kenneth Clarke told the Commons.

He was replying to Gwilym Roberts (Labour, Cannock) who as worried about coaches used by pensioners, youth groups, iisabled persons' clubs and similar bodies.

It was very unlikely that any such vehicle would be prosecuted in this country, or that any attempted prosecution would be successful, added Mr Clarke.

Whether a vehicle was privately owned and driven had to depend upon the particular circumstances of its use and it was not possible to provide a definitive list.

However, provided that a vehicle was owned by a body that was neither a commercial organisation nor a public undertaking, and provided that it was either never operated for hire or reward or was operated under a minibus permit it would appear to be outside the regulations.
