AN OPERATOR WHO claimed he had never received a call-up letter to a public inquiry has been given the benefit of the doubt and granted interim authority for six months while Vosa investigates his maintenance regime.

The letter had twice been sent to the wrong address, according to James R Brandrett of Manchester. While granting the interim restricted 0-licence for two vehicles, North-Western Traffic Commissioner Beverley Bell said she still had sonic concerns about his licence application.

When the case first came before the TC, Brandrett said he had let his original licence run out because he had sold his transport business around 2002. He had run around 14 vehicles in the name of Brandrett Transport working as a subcontractor for P&O Containers. He maintained that the licence revoked at a previous public inquiry had been held by his son James S Brandrett. Adjourning the hearing after the Brandretts had said they had not seen the call-up letter as it had been sent to the wrong address, the TC said it was "all very odd( CM 2 August).

When the hearing resumed, the TC said the Traffic Area Office (TAO) seemed to have made the same mistake twice. A copy of the call-up letter and her brief should have been sent to the right address but that had not happened.

She told Brandrett that if the TAO got it wrong operators were inconvenienced, but if he got it wrong someone could be killed.

Brandrett said the application had taken so long he had to sell the two vehicles he had in his possession.

Granting interim authority, the TC said Vosa would check whether Brandrett was properly maintaining his vehicles and his tachograph records,-Don't let me down," she told him.
