• RIA (Immingham) unlawfully deducted 33 from the wages of a driver delayed on the Continent, a Hull industrial tribunal has ruled.

The tribunal said that Melvyn White had been stranded in the Dunkirk corridor when his truck ran out of fuel. If he had gone via Zeebrugge he would not have run out of fuel.

White had difficulty in obtaining fuel but during the period he was without diesel he was looking after his vehicle, which was loaded, so he was clearly "at work".

It was wrong to take the view that he was not at work and not entitled to payment for was clearly a case where the wage was earned and the company, because its management felt annoyed with White, decided to penalise him by de no agreement, contractual or written, that entitled the company to deduct that amount, therefore, under the Wages Act 1986, it was unlawful.
