Which of the following most accurately describes the problem?

• A Leicestershire company has been granted a new international licence for eight vehicles and three trailers despite opposition from the occupiers of the premises over which there is no right of way to the proposed operating centre.

S&E Turner had applied to operate from premises in Leicester Road, Lutterworth belonging to H&J Morris, the licence to be a substitution for a six vehicle licence held by GBS (Midlands) based at Fleckney. The move was caused occasioned by the breakup of the GBS Partnership.

Gees Motors (Lutterworth) protested about the use of the right of way over their premises fearing damage to their land and property.

Evidence was given by Samuel Turner a director of the application company that Morris's premises were much more suitable than the.Fleckney premises and were already being used by a number of other operators.

Eastern Deputy Licensing Authority Cordelia Brock rejected a request that the licence only be granted for six vehicles and that the size of vehicles be restricted. She said she had heard no evidence relating to the environment. Though she sympathised with Gee Motors there was nothing she could do about the access — it was something that would have to taken up somewhere else.
