Licence lost for unauthorised use

• The threevehicle licence held by Wilfred Bielby, trading as Chase Plant Hire, has been revoked by North Eastern Licensing Authority Frederick Whalley following the use of an unauthorised operating centre and a VED conviction.
For Bielby, Gary Hodgson said that he had been told to quit his designated operating centre at Topeliffe. He had tried to return without success and was now operating from a site at Boroughbridge, where he had recently obtained planning permission for its use as a waste transfer site.
An application for authority to use Boroughbridge as an operating centre had been abandoned following an environmental representation, but licences had since been granted to other operators for the same site despite representations from the person concerned. And a further appli
cation by Bielby was about to be submitted.
Bielby said that the county council had told him it would be happy if he kept his one vehicle at Boroughbridge.
He agreed with the LA that he had carried on using the site after it had been drawn to his attention that he should not but he said he had nowhere else to park the vehicle.
Whalley commented that Bielby was saying that he had totally disregarded his legal obligations under his licence because he had nowhere else to park his vehicle.
Questioned about a conviction for not taxing his vehicle, which resulted in him being ordered to pay fines and back duty totalling £2,500, Bielby said that he had got into financial difficulties when he was out of action as the result of a road accident.
Whalley revoked the licence and said that the whole purpose of the environmental legislation was to ensure that vehicles were not kept in places that were environmentally sensitive.
if Bielby made a fresh application for a licence, said Whalley, he would need documentary evidence about his financial resources.
