• Tyne and Wear haulier Clinton Ervin, trading as Ervin Transport, of Woodley, was given an absolute discharge for an overloading offence after Wetherby magistrates heard that the unladen weight shown on the ministry plate of the vehicle concerned was inaccurate.

Prosecuting for the North Eastern Traffic Area, Alan Vickers said that a two-axled vehicle belonging to Ervin and carrying engineering equipment was found to be 470kg (13%) over its plated weight.

Ervin said that the vehicle would never have been overloaded if the Ministry plate had not shown the wrong unladen weight. The plate showed an unladen weight of 1,700kg, yet when he had it check-weighed, the unladen weight was 2,000kg. He had been in business for nine years and had never been convicted of overloading. The vehicle had been bought secondhand, and when first registered the gross weight had been under-stated.
