Which of the following most accurately describes the problem?

QTrundling peacefully down the M1 at 03:30 in the morning in my 16tonne parcel wagon at a steady 60mph, the inner tyre of the nearside rear axle blew without warning. After inspecting it, and because I only had 3.5 tonnes on board, I decided to travel at 25mph to the next service area five kilometres away, get my head down and replace the wheel in daylight. I have been told I was committing an offence.

AI take it that when the tyre blew it shredded, leaving you with just the wheel. I can see no offence as long as the rim could not come into contact with the road. I think this is a matter of personal judgement, and where your experience and professional competence comes into play. It is possible you could be summonsed with "using" a vehicle in a condition likely to cause a danger to other road users. However, if you were satisfied that there was no danger then I think you were safer in the service area.
