.Mr. P. Kenny, for the applicants, said they used their own 31-ton tippers ftir ,delivering to building sites in the Doi-feaster area. Most of their customers were building contractors and during the past 12 months, they had' many requests to carry for hire or reward. On C-licence work a vehicle was employed only about 2+ days a week.

After a customer witness had said that he wanted a lorry for unforeseen journeys at short notice and had transport difficulties, Maj.• F. S. Eastwood, Licensing Authority, commented: "You don4 expect people to have vehicles hanging up on hooks and available at an hour's notice; do you?" ' Evidence was given on behalf of Pearsons that of their fleet of 30 vehicles, 20 were tippers on B licence, carrying building materials in the Doncaster , area. More than 70 operators were doing this type of work locally. A schedule of availability produced was criticized by Maj. Eastwood on the ground that it showed holiday periods as ordinary working days.

Hiring at 11,000 ,a Month Mr. A. Wentworth Smith, a director of G. Earnshaw, Ltd., said they operated 22 vehicles on A and special, A licences, 'of which four were tippers. They had never refused work of this kind. Hiring figures were approximately £1,000 a month...

Representatives from -Dunscroft Haulage Co. and S. Paulucy also gave evidence of availability. Mr. T. B. Atkinson, for British Railways, submitted that no prima facie case had been made out. The, only witness admitted he had not tested all the available facilities.

Maj. Eastwood granted a ..13 licence, but restricted if to building materials for one customer within a radius' of 15 miles.
