nESPITE the increase of 74d. a

gallon in fuel tax, the Road Haulage Executive is not to raise its rates for the time being. Mr. C. E. Jordan, chairman of the transport committee of Birmingham Chamber of Commerce, made this statement on Monday.

Sir David Maxwell Fyfe said in the House of Commons, on Monday, that during the past year the Executive had made an appreciable operating surplus. The British Transport Commission as a whole is reported to have earned a small profit.

A POLICE appeal against a decision

by Ottery St. Mary magistrates succeeded before the Queen's Bench Divisional Court last week. The magistrates had dismissed informations against William George' Folland, proprietor of FoHand's Garage, Prince Rock, Plymouth, who, it was alleged, had uSed a goods vehicle without a carrier's licence.

The defence had contended that it was not a goods vehicle, as it was towing a caravan containing, among other things, the accessories of a boat and the personal property of the owner. The police submitted that the vehicle was constructed or adapted for the carriage of goods, and was a goods vehicle within the meaning of the law.

The magistrates held that there was reasonable doubt on this point. The Queen's Bench appeal was not opposed and was allowed with costs. The court remitted the case to the magistrates with an intimation that an offence had been proved.
