Which of the following most accurately describes the problem?

• Permitting drivers to exceed 41/2 hours' driving without taking the required amount of break, and allowing them not to use the mode switch on their tachographs, led to Independent Express Corporation being fined £1,100 by the Bristol magistrates last week.

The company admitted 12 offences of permitting drivers to exceed 41/2 hours' aggregate driving and 10 offences of permitting them to fail to use the mode switch. It was fined 250 on each offence.

The magistrates were told that the offences had come to light following a check on the company's tachograph records by Department of Transport traffic examiners.

Independent Express has since been merged with TDG partner Tuffnells.
