Which of the following most accurately describes the problem?

• A driver cannot count any rest lasting over 45 minutes, taken AFTER driving for 41/2 hours, as part of the break required for the next 41/2-hour driving period.

This means that break taken in excess of that required for the previous driving period cannot be carried forward..

This was ruled by Judge Simon Fawcus at Manchester Crown Court last week, ending months of arguments over how to interpret last December's European Court judgement on the 41/2-hour driving rule (CM May 26-1 June).
