Which of the following most accurately describes the problem?

• Consideration of action against a haulier convicted at Teeside in January has been adjourned by Licensing Authority Frederick Whalley because the haulier had not taken legal advice and was consequently ill-prepared.

Geoffrey Bayles, trading as Geoff Bayles Transport of Fishburn was convicted of one offence of making a false instrument, one of using the false instrument and one of receiving stolen property. He was given a six months prison sentence suspended for one year and ordered to pay £100 costs. There was also a conviction recorded against him for falsifying a tachograph chart.

Bayles said he had purchased two excise licence discs from an unknown person in a motorway service area at the time when money was slow coming in and he needed to tax a vehicle. He had only used one of the discs concerned and he had not realised the serious consequences.

Whalley said that before he reached a decision on Bayles' two vehicle licence, he required to see an analysis of his tachograph charts particularly since January to see if he was now behaving, and maintenance records and audited accounts for the last complete year.
