Which of the following most accurately describes the problem?

• Poynton Waste Disposal has been granted a licence without environmental conditions by North Western Licensing Authority, Roy Hutchings, despite objections from Macclesfield Borough Council.

Hutchings reserved his decision on an application by FAJA and R A Ridley trading as Poynton Waste Disposal for a new fourvehicle national licence following a reconstitution (CM, September 20).

He said that having considered written representations from local residents, he was not satisfied they had shown there would be any adverse environmental effects prejudicially affecting the use and enjoyment of their land.

The objection from the Council was based on the fact the operating centre, Nelson Pit, no longer had the benefit of planning permission. Nelson Pit had previously been used as an operating centre and an operator's licence and planning permission was something that he could not take into account.
