Which of the following most accurately describes the problem?

A driver who used a switch to disable the speed limiter fitted to his vehicle has been ordered to pay £285 in fines and costs.

When Andrew Cartledge of Growthorne, Berks, appeared before Chester magistrates he pleaded guilty to two offences of using a vehicle when the speed limiter had been interfered with, and also 11 offences of using a vehicle when the speed limiter was not operating.

Prosecuting for the Vehicle Inspectorate, Keith Henry said a tri-axle skip loader belonging to RE Tanner & Co • — and driven by Cartledge was stopped in a check at Dunkirk, Cheshire. An examination of the tachograph records showed the speed limiter was ineffective.

Cartledge was warned that the tachograph and speed limiter would be inspected, as it was suspected that a device had been fitted to disable the system. At that point Cartledge admitted that such a switch had been fitted and that he used it on a daily basis.

When asked who had fitted the switch, Cartledge replied: "I do not know the bloke from Adam. I got talking to a bloke who was doing a delivery in Birmingham; he had the same lorry. He fitted it while I was at the premises."

When asked when that was, he answered: "About three or four years ago."

Cartledge said that as soon as the company found out about the offences he was sacked, and was currently unemployed.
