A BID FOR a new licence by Jennifer Graves. trading as MI Graves International, following the revocation of her husband's licence has been refused by Eastern Traffic Commissioner Geoffrey Simms (pictured).

Graves had applied fora licence for 22 vehicles and 22 trailers to continue the business after her husband Martin was jailed for four years for falsifying records and manslaughter by negligence (CM 10 Aptil 2003).

The TC heard that an examination of records showed 16 vehicles had been used after Martin Graves' licence had been revoked: a total of 26,313km were unaccounted for, and drivers' hours offences had been committed by several drivers.

Refusing the application, the TC said there might be a perception within the haulage fraternity in Felixstowe that, despite Graves' reckless conduct and imprisonment, the business had continued to prosper. His wife had been given ample opportunity to make a fresh start by way of a new licence application. However, she appeared to have been oblivious to the requirement to apply for authority in her own name if the existing business was to continue operating.

The TC added that Jennifer Graves was keenly aware of the circumstances that led to her husband's downfall, namely the lack of proper control over his drivers' activities.

She had failed to satisfy him that proper arrangements were in place to ensure drivers complied with the drivers' hours and tachograph rules. Also, he could not be satisfied she met the requirement to be of good repute because of the unauthorised use and a failure to tax a vehicle.
