Which of the following most accurately describes the problem?

• Frank Davis (Chichester) Ltd., its director, Mr. F. Davis, and two drivers appeared at Chichester magistrates' court on Tuesday charged with a total of 79 hours and record offences. Eighteen summonses against a former driver, Mr. D. Shepard, of Chichester, were adjourned as he did not appear.

Pleading guilty on all counts, Mr. F. Davis was fined £58, the company £14 with 15 guineas costs and the two drivers a total of £30.

Prosecuting on behalf of the MoT, Mr. Derek Hansen said the offences arose out of three trips to Scotland and the North of England. Two drivers were pairing one vehicle and driving virtually continuously.

There was a lack of supervision and the drivers were allowed to do what they thought fit, he said. Mr. Hansen added that in 1965 both the company and Mr. Davis were fined for similar offences.

Mr. Christopher Doman, defending, said that the firm had a small office staff and during the first three months of this year Mr. Davis was under great pressure and worry with regard to other matters concerning his business and private life.

"These matters took his attention away from the business and he was guilty to a certain extent of letting the business run itself'", Mr. Doman explained. "A carrier must place reliance on drivers to follow the correct procedure and Mr. Davis placed too much reliance on his drivers."
