The Vehicle Inspectorate has made the following statement in response to the report "VI was warned about death crash company" (CM14-20 Oct):

• In January 1992 a complaint relating to the interpretation of the drivers' hours regulations by Travellers Coaches was received by the South East and Metropolitan Traffic Commissioner who asked the Vito investigate. To enable the investigation to be undertaken it was necessary to carry out an inspection of the company's tachograph charts.

As previously stated, this investigation coincided with a legal debate about the powers of Traffic Examiners to require the production of tachograph charts. Until this matter was resolved and the necessary legal advice was received, an alternative procedure for the inspection of the tachograph charts was being considered.

The Inspectorate's case file clearly shows that Bob Lintern (group manager) advised the Traffic Commissioners office that there was insufficient
