A charge that West Draytonbased Sweeney Transport had hired out a vehicle in a dangerous condition was dropped because the driver was not employed by the company. Charges against the company and driver Trevor Jackson arose from a wheel loss incident.

Mandula Nayeed, for the prosecution, told Ealing magistrates that in January a Renault tipper owned by Sweeney Transport was being driven by Jackson on Western Avenue when both offside drive wheels came off the !sear axle. One hit a bus; the other demolished a wall. Having discussed the incident with the

defence, Nayeed said no case would be made against the company.

For Sweeney, Chris Butterfield said the company had a leasing arrangement with RicMohn Transport, Documents showed that on the day in question the tipper had been leased to Richjohn which had agreed to maintain it. Jackson had been employed by Richiohn or was self-employed, he added. Sweeney did not need to know which.

The magistrates ordered the company's defence costs to be paid out of public funds.

Jackson pleaded guilty and was fined 175 with £30 costs; his licence was endorsed with three penalty points.
