A Nottinghamshire operator has lost his .1 appeal against the revocation of his I Operator's Licence with a year's disqualification.

Eastern Deputy Traffic Commissioner Robert .'3Iiwood made the revocation and disquarification lers against Retford-based Christopher Barber cause of his poor maintenance record, the use of icensed vehicles and a failure to adhere to a SORN claration.

In February 1997 then Eastern TO Brigadier Compton Boyd cut Barber's licence from five vehicles to three because of maintenance problems and a failure to declare convictions.

In June this year the OTC was told that Barber's prohibition and annual test record indicated serious deficiencies in his maintenance arrangements.

Barber maintained that he had been let down by a number of people, saying that he had sacked his office manager the previous day. He had also had to sack a number of employees for theft.

He agreed there had been a lot of prohibitions—for one there was absolutely no excuse: others were the fault of his maintenance people or were due to the apathy of his staff.

The OTC considered that Barber's difficulties arose from his own lack of supervision and noted that there had been no improvement since the previous Public Inquiry five years ago.

In a letter to the Transport Tribunal asking for the appeal to be heard in his absence, Barber said his business delivering fuel was his only form of Income. He had three employees with families who depended upon his business and the use of unauthorised vehicles had been due to a mistake which he had not picked up.

The Tribunal said: We are satisfied that the orders of revocation and disqualification were properly made."
