Which of the following most accurately describes the problem?

that in contrast to an hgv driving licence, the psv licence can be endorsed by a court for certain offences peculiar to the holder of such a licence. Is this so and what are these endorsable off ences ?

A Section 146 of the Road Traffic Act 1960 makes provision for the making of regulations governing conduct of drivers and conductors.

Subsection (2) states that if a person fails to comply with those regulations he shall be liable to a fine and, if the court thinks fit, particulars of the conviction may be endorsed on the licence granted under Section 144 of the Act (psv drivers' and conductors' licences).

The relevant regulations are those contained in Statutory Rules and Orders No. 619 of 1936 in which the details of how drivers and conductors should behave. Endorsement of the licence would be unlikely to be enforced for any but serious offences.

For instance an endorsement for smoking during a journey is most unlikely : while refusing information to a police constable or other authorised person might well result in endorsement.
