• Failure to replace a defective tyre after a vehicle had been stopped by police ed to CBS, of Coppull, Lanes, and one of the company's drivers being ordered to pay £500 in fines and costs by Garstang magistrates.

The company and driver Ian Brownley each admitted two offences of using a vehicle with a defective tyre and one offence of using it without a current test certificate.

Peter Bailey, prosecuting, said that on 2 March a police officer had stopped a Volvo tipper and found that the nearside inner rear tyre had a strip 500mm long missing, exposing the steel cords to a width varying between 25mm and 75mm Two hours later the same officer saw the Volvo, now laden, travelling in the opposite direction. The wheel had not been changed and Browndey said that his transport manager had told him to change it when he got back to base.

The test certificate had expired two days previously.

For the company, Tim O'Riordan said the vehicle had been one of three due to be tested at the same time. CBS could not afford all three tests on one day. It applied to postpone the test of one vehicle and through an administrative error the wrong vehicle was chosen.

As far as the tyre offences were concerned, there had been a misunderstanding when the driver radioed in after being stopped.

The magistrates fined Brownley £180 and the company £280, ordering them to each pay £20 prosecution costs.
