THE managing director of a Forest of Dean haulage.firm was told that he had come close to 'putting himself out of business, at a Section 178 inquiry by Mr. J. R. C. Samuel-Gibbon, the Western Licensing Authority, at Cheltenham on Tuesday.

He was Mr. V. C. James, managing director of James Smith (Bicknor) Ltd., attending the hearing for consideration of the revocation or suspension of A licences for 26 vehicles. It was reported that the firm had three convictions and 16 prohibitions against them for faulty maintenance of vehicles.

Mr. Samuel-Gibbon told Mr. James: " You have gone to the very cliff edge in this." He adjourned a renewal application for the licence but suspended two B-licensed vehicles for three months and an A-licensed vehicle for two months from June I.

He said he would be unable to give a decision on renewal until a system of maintenance was in operation, adding: " Mr. James has brought me jolly near to the position where 1 might have had to put him out of business.

"Last November when this company was before me an undertaking was given in regard to maintenance by Mr. James and it was on this understanding that I added three vehicles to the company's authorized fleet. Quite obviously, the undertaking was not implemented in any sort of practical way."

Mr. Ian Jenkins, for the company, said that in March Mr. James lost the sight of an eye in an accident and that had tended to make him take a little less interest in his job than normal. Treatment caused him to be away from work.

Mr. James stated that over £38,000, excluding labour charges, had been spent on repairs and maintenance last year for the firm's 26 A and 10 B vehicles. He agreed to give a fresh undertaking that a proper maintenance system would be put into effect in the company.
