AN appeal by the British Transport Commission against the addition of three vehicles to the A licence of Mr. L. Roberts,.Scartop, Lockwood, Huddersfield, by the Yorkshire Deputy Licensing Authority was dismissed by the Transport Tribunal on Monday.

Mr. J. Booth, for the B.T.C., said Mr. Roberts, who had three vehicles on C-hiring allowance for one customer, had applied for them to be added to his existing A licence. This licence entitled him to carry building materials, foodstuffs, and new and scrap metals, mainly in Yorkshire, from the East, and West Midlands and London.

The point was whether the Authority was correct to grant the licence on normal-user terms, in view of the evidence that was given, or whether, having heard the evidence, he should have invited the applicant to amend his application.

There was not sufficient evidence to justify the addition of three vehicles, said Mr. Booth. Mr. Roberts' two vehicles on A licence were able to earn much more than three on C hire. "This leads one to the conclusion," Mr. Booth said, "that the three vehicles on C hire were under-utilized." •

Mr. P. Kenny, for the respondent, said five vehicles were needed. If the three concerned in the appeal ceased to operate, the effect on the customer's manufacture of aluminium-bronze alloy would be disastrous.

Mr. Hubert Hull, president, said there was sufficient evidence from the hirers that they would give Mr. Roberts enough work to justify the authorization of three vehicles.
