A GROCER whose truck was impounded when he carried on operating after his 0-licence was revoked has failed to get it back.

Seeking its return from South Eastern & Metropolitan Traffic Commissioner Christopher Heaps, Mohammed Amin. of Luton, submitted a written representation claiming he could not speak or understand the English language, so he was not fully aware of the regulations he needed to adhere to.

He was only using the truck to supply fruit and vegetables to his shop. He now understood that this was an offence but if the truck was taken away he would suffer a great loss and his business would fail to thrive. He urged the TC to give him a second chance, saying that if the vehicle was returned he would immediately apply for an 0-licence.

Refusing to return Amin's truck,theTC said that when the vehicle was impounded it had a gross overload of 9% When interviewed by a traffic examiner, Amin had admitted that he had previously held an 0-licence — but that licence had been revoked by Eastern Traffic Commissioner Geoffrey Simms at a public inquiry with effect from 15 January.Tachograph charts in Amin's possession dated between 30 January and 16 June indicated continued use of the vehicle after the date of revocation.
