Which of the following most accurately describes the problem?

• Truro Magistrates Court has decided that drivers who voluntarily take on extra work after the end of their driving day do not need to keep a record of those hours.

Charges were dropped against 11 drivers employed by Westfield Transport who had failed to keep written records of work done when they were not driving. Another driver was

tried but found not guilty.

The period for which there was allegedly no record was when the drivers were being driven in a van which their company sent to collect them, or when they were doing extra work but not driving.

The case against the company has been adjourned while the Department of Transport considers an appeal.
