According to papers before the court, Leitch was supervising vehicles entering and leaving ferries at Eastern Docks, Dover, when the accident happened. Mrs Leitch claimed that an articulated lorry struck him so that he became entangled in the rear wheels of the trailer. He suffered multiple injuries and died the same day.

His widow blamed the driver and claimed that Townsend was liable for his negligence. There were several areas in dispute before agreement was reached, said her counsel, Christopher Gibson. "The question of liability remains in dispute," he added.
