Which of the following most accurately describes the problem?

• Transport lawyer John Backhouse is appealing to hauliers for clarification on the meaning of the "sixth day" in EU law under regulation 3820/85.

He is acting on behalf of a company whose driver is charged with failing to take a weekly rest after six consecutive daily driving periods: the case turns on when the sixth and final daily driving period ends.

Rules allow the weekly rest period to be postponed until the end of the sixth day if the total

driving time over the six days does not exceed the maximum corresponding to six daily driving periods, or 56 hours.

In the case Backhouse is handling the driver had only driven for about 51 hours when he started his weekly rest.
