• Ferndales Transport Company (Hull) and one of its drivers, were cleared of alleged overloading offences by the Hull Magistrates last week when the defence argued that a dynamic axle weigher was the nearest available weighbridge capable of accurately checking axle weights and not a conventional plate weighbridge which was closer to the loading point.

Prosecuting for Humberside Trading Standards, Jane Hardy said that when a five-axled articulated outfit driven by William Longdon and loaded with fish had been weighed on the dynamic axle weigher at King George Dock, its fourth and fifth compensating axles had weighed 19,890kg. This was 1,090kg (5.7%) overweight.

Trading standards officer Peter Ward said that as vehicles stopped at the security office at West Gate before leaving the docks, they were directed to return to the dynamic weighbridge via the roundabout on Corporation Road.

Longdon said that he had been specifically told by the company to use the dynamic weighbridge to check his axle weights, but as the weighbridge was congested he decided to go out through West Gate, round the roundabout and return to a layby to await an opportunity to check weigh.

A director of the company, Keith Newsome, said there had been problems with axle weights in the past and instructions had been given to all the company's drivers to check their axle weights on the dynamic weighbridge before leaving the dock area, and not on the conventional weighbridge.

Gary Hodgson, defending, maintained that the dynamic axle weigher was the nearest available weighbridge on which the driver could accurately check his axle weights.
