FROM THIS WEEK the maximum penalty for failing to disclose who was driving a vehicle at the time of an alleged offence doubles to six points.

Derek Millard-Smith, a specialist in regulatory law at Manchester solicitors Pannone LLP, says: It will raise difficulties for drivers who were not driving at the time of the offence and are genuinely unable to identify who was.

The changes may encourage situations where a registered keeper unable to identfythe driver will accept three points rather than risk six, even though he or she dldn t commit the offence." This change in the law could be particularly tricky In fleets that regularly swap trailers. If a numberplate is forgotten on the back of a trailer and pulled by a differ ent tractor, driver identification could be very complicated.
