IN A WRITTEN judgment, the Transport Tribunal has agreed with the West Midlands Licensing Authority that suspension of three out of eight vehicles for three months was the correct way to discharge further overloading by a haulier.

R. A. and P. R. Troughton had appealed to the Tribunal (CM, October 6) arguing that the sentence by the LA was harsh. Until 1982 there had been a clean record. Three offences had fol lowed in 1982 and 1983 for overloading.

For the defence, Michael Carless had argued at the Tribunal that the convictions had occurred as a result of overloading for return journeys. He had asked "is suspension going to make the appellants any more careful?"

In answer the appeal was dismissed at the Tribunal and officially in the judgment. The suspension began on October 8.
