Which of the following most accurately describes the problem?

T Hornsea (East Riding, Yorks) Magistrates Court last week a fine of £20 was Imposed on Mobil Oil Co. Ltd., of London, for using a tanker with a tyre in a dangerous condition. A summons in respect of using a brake not maintained was dismissed.

The magistrates were told of an accident at Catwick when the tanker, carrying 4,000 gallons of petrol, crashed into a brick wall. After the accident the driver of the vehicle said that the tyre burst, alleged Insp. A. L. Watkinson. The inspector said that a protective repair had been carried out on the inside of the tyre, and submitted that it should not have been used on a tanker carrying petrol.

For Mobil Oil Co., Mr. L. J. Mallin, motor vehicle manager, claimed that the vehicles were maintained to an extremely high standard. The particular tyre in question (a manufacturer's remould) had

never been taken off since it was fitted and at the time of the accident had done more than 9,000 miles. Evidence was given by a representative of the North British Rubber Company that the tyre was completely safe; the damage to it could have been caused by impact.

The driver of the vehicle, Mr. James Cade, was summoned for using a tyre in a dangerous condition and with a brake not maintained. The second summons was dismisssed and Cade was given an absolute discharge in the first case.
