ON appeal by Lancashire United Transport, Ltd., the Minister of Transport has overthrovvn a decision of the North Western Traffic Commissioners granting Mr. J. Williams an express service from Platt Bridge to the works of Ward and Goldstones, Ltd., at Hindsford.
The Minister agrees with the Commissioners that they should not have excluded evidence by people who had used the service previously operated illegally by Mr. Williams, because " it was legitimately relevant to the question of the need for the proposed service."
Mr. J. M. Glen, who heard the appeal, thought that if he had been in the Commissioners' place he would have refused the application, but he nevertheless recommended with hesitation that the appeal should be dismissed, because of the wide experience of the Commissioners and their greater opportunity of assessing the evidence, and because the grant was limited.
After giving full weight to the advantages enjoyed by the Commissioners in these respects, the Minister does not however, think that the L.U.T. service tc the factory was so inadequate that it justified even the limited grant to Mr Williams. Allegations of inadequac) amounted to no more than complaints of an occasional need to stand for the first part of the evening journey.
