Which of the following most accurately describes the problem?

AN admission that a substantial amount of work had been carried on for six months outside the radius stated on the applicant's B licence, led to the refusal of a variationsought before Mr. L. H. Shelton, acting North Western Deputy Licensing Authority, at Wrexham on Monday.

Mr. D. Roberts, Ruthin, had applied to add "goods as required for the Claiglielo Granite Co." to the conditions of a one-vehicle B licence.

The applicant's son, Mr. T. 0. Roberts, said that the granite company had been their only customers since April. Road materials had been carried to Birkenhead, the Wirral, Liverpool and Manchester. He knew that some of these places were outside the permitted mileage.

Questioned by Mr. G. H. P. Beames, for the British Transport Commission, Mr. Roberts agreed that the reason for the application was infringement of the law. His father had retired in June and probably did not know about it.

Mr. F. G. Ellcock, quarty manager, said that the Claigllelo company had 10 C-licensed vehicles but also hired. Replying to Mr. J. E. Jones, for Messrs. K. B. Parry and Sons, Ruthin, who also objected, Mr. Ellcock agreed that Parry were originally their main hauliers. He added that Parry had let them down on occasions, and in consequence two additional C vehicles were acquired. The decline in Parry's carrying was not solely because of the employment of Roberts.

Questioned by Mr. Shelton, Mr. Ellcock said he was unaware Roberts had been hauling outside his radius.
