Which of the following most accurately describes the problem?

• Kidderminsterbased Philip Stanford, trading as Wolverley Plant Hire, has been warned that if he continues to park vehicles at places other than his authorised operating centre, he is likely to have his licence revoked.

Stanford holds a licence for nine vehicles and three trailers with a condition on his licence that only one vehicle and two trailers be kept at any one time at an operating centre at the Old Rover Works.

Traffic examiner Janice James told a Birmingham disciplinary inquiry that in September and October she had seen as many as three vehicles and five trailers parked overnight at the Old Rover Works. She also had evidence of the use of untaxed vehicles. Stanford maintained that the vehicles had been at the Old Rover Works for test preparation work.

One vehicle had been bought for spares and was being dismantied, and two of the trailers were scrap trailers. He agreed that vehicles which made early starts were regularly parked at a lorry park in Stourport on Severn.

West Midland Traffic Commissioner John Mervyn Pugh commented that lorry parks were for visiting vehicles. They could not be used as a substitute operating centre. He adjourned the proceedings for Stanford's affairs to be investigated by a DOT financial assessor, after being told that tines and costs totalling £19,145, imposed for depositing controlled waste without a waste disposal licence, were being paid off at the rate of £250 a month.

For Stanford, Michael Carless said it was not a case of Stanford going round the country flytipping. He had deposited waste where his customers required him to do, one of the contracts had run for five years.

Carless said that if Stanford paid the fines and costs in one go it would finish the business. That clearly put his financial standing in doubt, said Mervyn Pugh.

Carless said that four vehicles that had been due to be taxed at the beginning of May had been taxed.
