A Hertfordshire haulier whose brother presented a forged Operator's Licence to a finance company in order to obtain a vehicle for his unlicensed firm, has narrowly escaped losing his own 0-licence.

The Eastern Traffic Commissioner Geoffrey Simms was considering taking action against the existing licence held by Barry Watts, trading as BJ Watts Transport of Buckland, for eight vehicles and nine trailers.

Buckland Transport, based at the same operating centre, was also making a bid for a fresh licence for 10 vehicles and 10 trailers. Its directors were Karen Yoxall and John Curry The TC said that Acremills, whose directors were said to be Watts' brothers Graham and John Curry, had been operating vehicles illegally, one of which was impounded. ROM Asset Finance applied for its return, claiming it was unaware of the unauthorised use, having been shown an 0-licence document. This turned out to be Barry Watts' licence with his name replaced by that of the company, Barry Watts said that the Buckland premises were jointly owned by his brother and sister. He denied anything to do with the forgery and said the first he knew of the matter was when he received the letter from the Traffic Area.

He said that he had not heard of Buckland Transport before and it was not true it owned or leased the premises. Acremills parked vehicles at the premises but they were up for sale.

He was aware that his brother had been transport manager of Crossland I port, whose licence had revoked in 1999. Two vel specified on his licence registered to Acremiils.
